Imperial County Board of Supervisors Meeting Highlights for January 15

IMPERIAL COUNTY, Calif – On Tuesday, January 15 the Board of Supervisors held its regular meeting. Following are highlights of the meeting:

The Board conducted a Public Hearing to consider a Resolution to confirm the rates of Commercial Cannabis Activity taxes as approved by Imperial County Voters during the June 5, 2018 Primary Election. By a 4-0 vote, the Board ratified the following rates:

  • A general tax of eight percent (8%) on the gross receipts received by retailers of cannabis and cannabis products;

  • A general tax of five percent (5%) on the gross receipts received by manufacturers of cannabis and cannabis products; and

  • A general tax of fifteen dollars ($15) per square foot on the space utilized for commercial cultivation of cannabis. On July 1, 2020, the maximum amount of this tax shall increase to twenty dollars ($20) per square foot. On July 1, 2022, the maximum amount of this tax shall increase again to twenty-five dollars ($25) per square foot.

The Board approved a Conditional Use Permit along with a Public Benefit Agreement between the County of Imperial and Titan II, LLC relating to the Seville 4 Solar Project. Once built, the project should generate a total of approximately $300,000 in sales tax revenues to the County and the Local Transportation Authority (LTA). In addition, the project is expected to contribute between $98,500 and $157,500 to the County’s Community Benefit Program. Since the land has not been farmed for the past 10 years, this project is not required to make an Agricultural Benefit payment.

The Board also approved four Conditional Use Permits and corresponding Public Benefit Agreements between the County of Imperial and 8minutenergy pertaining to the Laurel Cluster Solar Farm Projects. Upon completion, these projects should produce sales taxes totaling almost $2,925,000 to the County and the LTA, along with at least $3,700,000 into the Community and Agricultural Benefit Programs.

The Board approved to schedule a regular Board of Supervisors Meeting on Tuesday, January 29, 2019 at 8:00 a.m., preceding a Community Benefit & Agricultural Program Workshop at 1:00 p.m. The workshop is intended to be a working session related to the structure of the two aforementioned programs.
